This End User License Agreement (the “Agreement”) is a legal agreement between you (the “Customer” or “User”) and Farmers Choice Dispensary, a licensed cannabis dispensary in New York (“we,” “us,” or “our”). By accessing or purchasing products from our dispensary, whether in-store, online, or through any digital platform (collectively, the “Services”), you agree to comply with the terms and conditions of this Agreement. If you do not agree with any terms or conditions, you must refrain from using our Services.

1. Eligibility and Compliance with State Laws
   You must be at least 21 years of age, or 18 years with a valid medical marijuana certification from a registered physician, to purchase products from our dispensary.
   You must present a valid, government-issued photo ID and any required documentation proving eligibility, such as a medical marijuana card, upon each transaction.
   You acknowledge that the possession and use of cannabis products are regulated by New York state laws, and you agree to use products in compliance with these laws.
2. Responsible Use
   You agree to use all products responsibly and understand the risks associated with cannabis use, including potential impairment.
   You understand and agree not to operate vehicles, machinery, or undertake any activity that requires full mental alertness while under the influence of cannabis.
   You acknowledge the potential for adverse health effects and assume full responsibility for any risks and liabilities that may arise from your use of cannabis products.
3. No Resale
   Products purchased from Farmers Choice Dispensary are intended solely for personal use and may not be resold, distributed, or shared with others in any form. Unauthorized resale or distribution is strictly prohibited.
4. Product Information and Disclaimer
   We strive to provide accurate information about our products, including their potency, effects, and potential benefits. However, we do not make any guarantees regarding the accuracy of this information, as individual reactions to cannabis may vary.
   We make no representations regarding the efficacy or safety of our products, and you agree to consult a medical professional if you have any health concerns prior to use.
   We disclaim all liability related to the use or misuse of our products, including but not limited to physical, mental, or emotional side effects.
5. Limitation of Liability
   Under no circumstances will Farmers Choice Dispensary, its affiliates, employees, agents, or contractors be liable for any direct, indirect, incidental, or consequential damages arising from the purchase, use, or misuse of cannabis products or the use of our Services.
   This limitation of liability extends to any claims based on warranty, contract, tort, or any other legal theory.
6. Returns and Refunds
   Due to the nature of cannabis products, all sales are final. We do not offer returns, exchanges, or refunds except where required by law.

   By using our Services, you agree to our Privacy Policy, which governs the collection, use, and protection of your personal information.
8. Changes to This Agreement
   Farmers Choice Dispensary reserves the right to modify or amend this Agreement at any time. Your continued use of our Services following any changes constitutes acceptance of the revised Agreement.

   This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
